By accessing or using the website appivanta.com or engaging services from Appivanta Softwares Pvt Ltd ("Company"), you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of our services.
Appivanta Softwares Pvt Ltd provides IT development services including but not limited to website development, mobile application development, software development, AI/ML solutions, cloud services, UI/UX design, and IT consulting. Specific project terms are governed by individual project agreements.
Upon full payment of all agreed fees, intellectual property rights for custom-developed software, designs, and code developed exclusively for a client will transfer to the client. Pre-existing frameworks, libraries, and tools used in development remain the property of their respective owners. Appivanta retains the right to showcase completed work in its portfolio unless explicitly agreed otherwise.
Changes to the agreed project scope after commencement will be subject to a change order process. Additional requirements will be estimated and billed separately at our current rates. We reserve the right to adjust timelines based on scope changes.
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. We do not disclose client information to third parties without consent, except as required by law.
We warrant that our services will be performed with professional skill and care. Our liability for any claim arising from our services is limited to the total fees paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Post-launch support is provided as specified in the project agreement. Support covers bug fixes directly related to delivered functionality. New features, third-party service failures, or issues arising from client modifications are not covered under standard support.
Either party may terminate a project agreement with 30 days' written notice. In case of termination, the client is liable for payment for all work completed up to the termination date. Advance payments are non-refundable unless the Company fails to commence work.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
